Mayor Les Smith opened the Regular February 25, 2008, City Council Meeting at 7:30 PM in the Gladstone City Council Chambers.


Item 2. on the Agenda. ROLL CALL


Mayor Les Smith noted that all Council members were present.


Item 3. on the Agenda. PLEDGE OF ALLEGIANCE.


Mayor Les Smith led the Pledge of allegiance, in which all joined.


Item 4. on the Agenda. APPROVAL OF THE FEBRUARY 11, 2008, CITY COUNCIL MEETING MINUTES.


Councilman Wayne Beer moved to approve the Regular February 11, 2008, City Council Meeting Minutes as presented. Councilman Carol Rudi seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Carol Rudi, Mayor Pro Tem Mark Revenaugh, and Mayor Les Smith. (5-0)



Item 5. on the Agenda. SPECIAL PRESENTATION TO Dr. Robert Marx. DDS.


Mayor Smith stated he was invited to the 20th anniversary of the “Have a Heart Day” at Dr. Marx’s office in Gladstone. Mayor Smith said he had never been there and was quite impressed. “Have a Heart Day” is when Dr. Marx offers dental cleaning and exams to children who might not otherwise receive dental care. They have seen nearly 2,000 children since he began this program. Mayor Smith said in visiting with the office staff that day, he learned that Dr. Marx does what most dentists do; he gives out thousands of toothbrushes and toothpaste and so forth. Dr. Marx sponsors Little League Baseball and has coached since 1992. Mayor Smith said Dr. Marx also does other things, such as he has helped in collecting over $10,000 for the Salvation Army Bell Ringing Program. Dr. Marx has been a sponsor in the “Send a Kid to Camp” program, and has sponsored a Northland food drive and collected thousands of pounds of food for Harvesters. Dr. Marx has sponsored children in the City wide “Set a Good Example” contest, with three other teams achieving national recognition. Dr. Marx also conducts toy drives for “Operation Break Through”.


Mayor Smith said upon learning all of this, and because of Dr. Marx’s commitment to youth, about which our community feels strongly, it dawned on him that Dr. Marx is an unsung hero of our community. Mayor Smith said Dr. Marx was invited this evening so he and City Council members could present to him, his wife Terry, and his entire staff a Proclamation. Mayor Smith invited Dr. Marx to join him in the front of the Council Chambers, and said that due to Dr. Marx’s impressive resume, he would not be presenting a Proclamation, but would instead be presenting a Key to the City. Mayor Smith read and presented the Key to the City to Dr. Marx. Mayor Smith invited all City Council members to join him in front of the Council dais.


Dr. Marx said he was moved.


Mayor Smith said this was his second term as Mayor, and this is only the second Key to the City he has presented.


Dr. Marx said he grew up in Gladstone and he loves this City. Dr. Marx said he came up with the idea of “Have a Heart Day” 20 years ago, with the help of his Staff. Dr. Marx said he was amazed how much parents love their children, and this is pretty much universal, and they wanted to do something for them, and some of the children were not receiving care. It was not because their parents didn’t want to provide dental care; they just could not do it. Dr. Marx said the need is great. Dr. Marx said he is very proud of dentistry; it is a wonderful profession, but medical and dental care is expensive. Dr. Marx said he does not do this for any honor, and he was not planning on this, so he is overwhelmed by this honor. Dr. Marx thanked the Mayor and City Council members. Dr. Marx said he had several key members of his staff present this



evening, and introduced them as follows: his wife, Terry Marx, Director of the Dental Office; Wanda Foren, Lead Dental Assistant; and Kelly Green, Dental Hygienist. Dr. Marx said when you see 130 children in a day, it is moving, and he is just the tip of the iceberg. His staff is doing an incredible amount of work. They do it because they care.


Mayor Smith said there were children everywhere at the event, and he was fortunate to read the proclamation from the Governor, which was very nice.


Dr. Marx said Claire McCaskill also sent a commendation, which he appreciated.


Mayor Smith said Dr. Marx is no longer an unsung hero, and now Dr. Marx knows why he needed all the information. Mayor Smith thanked Dr. Marx for all he does for the community, which was followed by applause from the audience.


Item 6. on the Agenda. CONSENT AGENDA.


Following the Clerk’s reading, Councilman Carol Rudi moved to accept the Consent Agenda as presented. Councilman Wayne Beer seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Carol Rudi, Mayor Pro Tem Mark Revenaugh, and Mayor Les Smith. (5-0)


Councilman Carol Rudi moved to adopt RESOLUTION R-08-13, authorizing Change Order Number 2 in the amount of $71,531.25 to the contract with Insituform Technologies USA, Incorporated for the Mill Creek Cured in Place Pipe (CIPP) Phase 2 Project. Councilman Wayne Beer seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Carol Rudi, Mayor Pro Tem Mark Revenaugh, and Mayor Les Smith. (5-0)


Councilman Carol Rudi moved to approve a BUILDING PERMIT: for an addition to an existing mausoleum at White Chapel Memorial Gardens, 6600 North Antioch Road. Owner/Applicant: Stewart Enterprises, Inc. Councilman Wayne Beer seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Carol Rudi, Mayor Pro Tem Mark Revenaugh, and Mayor Les Smith.

Councilman Carol Rudi moved to approve the JANUARY FINANCIAL REPORT. Councilman Wayne Beer seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Carol Rudi, Mayor Pro Tem Mark Revenaugh, and Mayor Les Smith. (5-0)


REGULAR AGENDA


Item 7. on the Agenda. COMMUNICATIONS FROM THE AUDIENCE.


Brian Bechtel, Athletic Director at Maplewoods Community College, said he was present on behalf of Maple Woods Community College President Merna Saliman, who was unable to attend today, to formerly thank the City for the soccer fields that were built at Happy Rock Park this past year. Mr. Bechtel reported they were able to play both men’s and women’s soccer for the first time on those fields, and while they didn’t win any championships, it was a great field and a great opportunity. Mr. Bechtel said he knows it was a significant investment on the City’s part to install the scoreboard, fencing and everything else, and they do recognize that and appreciate it.


Mr. Bechtel said on behalf of the college, he would like to present to Mayor Smith and City Manager Kirk Davis a signed ball from the soccer team.


Mayor Smith and City Manager Davis thanked Mr. Bechtel.


Mayor Smith said this is an example of another partnership that the City has in the community. Mayor Smith offered congratulations to City Manager Davis, and asked him and Parks and Recreation Director Sheila Lillis to take back to their staff members his congratulations for this fine facility.


City Manager Davis reminded Mayor Smith that at the last City Council meeting, the City Council approved an agreement to assist with the college’s paramedic program, and hopefully, this will open up the opportunity for their students to work for our City.

This is another in a long line of partnerships that benefit our community.


Item 8. on the Agenda. COMMUNICATIONS FROM THE CITY COUNCIL.


Councilmember Carol Suter offered congratulations to Staff, City Council members, and volunteers who made the Community Center-Natatorium dedication on Saturday such a fun and fabulous quality event that it was. The activities were as good as the facility and that is saying a lot.


Councilman Wayne Beer agreed with Councilmember Suter.


Councilman Carol Rudi offered congratulations to all involved with the Community Center-Natatorium dedication, and said she heard so many comments about how wonderful the building was, and she talked to a few people who were unable to attend, and they really regretted missing the event, as it was a lot of fun.


Mayor Pro Tem Mark Revenaugh had no comments at this time.


Mayor Les Smith stated he wished to echo the comments from the other City Council members about the Community Center-Natatorium dedication. The dedication was very well received by the community, and excitement continues to grow.


Item 9. on the Agenda. COMMUNICATIONS FROM THE CITY MANAGER.


City Manager Kirk Davis offered his thanks to Parks and Recreation Director Lillis and her staff, who did all the work in putting the dedication together. It was a lot of fun, and there was a great crowd. The food in the conference rooms was also a hit with everyone. City Manager Davis reminded everyone that on March 10, 2008, most of the City Council will be at the National League of Cities conference, in Washington, D.C., so there will not be a City Council meeting that night. The next City Council meeting will be March 24, 2008.


Item 10. on the Agenda. RESOLUTION R-08-14, amending the 2008 Annual General Fund Budget, Combined Water and Sewerage System Fund Budget, and Municipal Pool Fund Budget for the City of Gladstone, Missouri, and authorizing expenditures of funds.


Councilman Carol Rudi moved to adopt RESOLUTION R-08-14, amending the 2008 Annual General Fund Budget, Combined Water and Sewerage System Fund Budget, and Municipal Pool Fund Budget for the City of Gladstone, Missouri, and authorizing expenditures of funds. Councilman Wayne Beer seconded.


Mayor Smith suggested for next year’s budget that if the “Robo Cop” unit is nonfunctional, that Staff pursue bids on a new one or a reconditioned unit, or whatever it takes to get it up and running, as it has been seen to be very effective.


City Manager Davis said the mechanics of the old one are pretty antiquated, so we will be looking at a new unit.

Item 11. on the Agenda. FIRST READING BILL 08-08, approving the Litigation Settlement Agreement with Sprint for payment of business license taxes for Cellular Telephone Service.


Mayor Pro Tem Mark Revenaugh moved to place Bill 08-08 on First Reading. Councilmember Carol Suter seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Carol Rudi, Mayor Pro Tem Mark Revenaugh and Mayor Les Smith. (5-0). The Clerk read the Bill.


Mayor Pro Tem Mark Revenaugh moved to accept the First Reading of Bill 08-08, Waive the Rule and place the Bill on Second and Final Reading. Councilmember Carol Suter seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Carol Rudi, Mayor Pro Tem Mark Revenaugh and Mayor Les Smith. (5-0). The Clerk read the Bill.


Mayor Pro Tem Mark Revenaugh moved to accept the Second and Final Reading of Bill 08-08 and enact the Bill as Ordinance 4.066. Councilmember Carol Suter seconded.


Roll Call Vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Carol Rudi, Mayor Pro Tem Mark Revenaugh and Mayor Les Smith.
