Item 2. on the Agenda. ROLL CALL


Mayor Carol Rudi opened the Regular February 22, 2010, City Council Meeting at 7:30 PM in the Gladstone City Council Chambers, and noted that Councilmember Carol Suter was not able to attend the meeting as she was out of the country.


Item 3. on the Agenda. PLEDGE OF ALLEGIANCE.


Mayor Carol Rudi led the Pledge of Allegiance, in which all joined.


Item 4. on the Agenda. APPROVAL OF THE REGULAR FEBRUARY 8, 2010, CITY COUNCIL MEETING MINUTES.


Councilman Mark Revenaugh moved to approve the Regular February 8, 2010, City Council Meeting Minutes as presented. Councilman Barry McCullough seconded. The vote: All “aye” – Councilman Barry McCullough, Councilman Mark Revenaugh, Mayor Pro Tem Les Smith, and Mayor Carol Rudi. (4-0)


Item 5. on the Agenda. PROCLAMATION recognizing the diverse cultural life of our Metropolitan community and the traditional Chinese culture portrayed in the 2010 World Tour of Shen Yun Performing Arts at the Music Hall in Kansas City, Missouri on March 13-14, 2010. Recipient: Barbara Gay.


Mayor Rudi read and presented the Proclamation to Barbara Gay, who thanked the Mayor and Council members. Ms. Gay handed out flyers for the Shen Yun performances, which will be held March 13-14, 2010, in the Kansas City Music Hall. Ms. Gay invited everyone to attend.


PROCLAMATION recognizing the accomplishments of ten Northland students in the F.I.R.S.T. (For Inspiration and Recognition of Science and Technology) Program and winners in the F.I.R.S.T. LEGO League competition, a programmed robotic exercise in a series of challenges within an allotted time.


Mayor Rudi read and presented the Proclamation to the ten-member Northland team, Up NeXT, comprised of Cooper Lehr, Andrew Marshall, Peter Marshall, Aspen Speiser, Cale Speiser, Daniel Andrews, Keenan Conkling, Ian Canon, Zane Canon, and Cullan Fritts, who are girls and boys, ages 9 to 14. Mayor Rudi presented the framed Proclamation to the team, and presented 10 letter sized Proclamations to each team member. Team members thanked Mayor Rudi and Council members.


Mayor Rudi noted that there were Boy Scouts in the audience, and she invited them to introduce themselves as follows:


Tommy Gussinger stated he was in 7th grade at St. Andrews School, and is in Troop 180.

Henry Gates stated he attends Antioch Middle School, and is in Troop 314.


Both Scouts are working to earn their Citizenship in the Community merit badge.


Mayor Rudi thanked the Scouts for being in attendance at the meeting, and suggested if they need any information to contact the City or City Council members. Mayor Rudi noted there were a large number of young people in the audience, and the City is always looking for young people to have input with City projects.


Item 6. on the Agenda. CONSENT AGENDA


Councilman Barry McCullough moved to approve the Consent Agenda as presented. Councilman Mark Revenaugh seconded. The Vote All “aye” - Councilman Barry McCullough, Councilman Mark Revenaugh, Mayor Pro Tem Les Smith, and Mayor Carol Rudi. (4-0).


Councilman Barry McCullough moved to adopt RESOLUTION R-10-07, authorizing the City Manager to execute an agreement with Hi-Gene’s Janitorial Services for services at City Hall, Public Works building, and Water Treatment Plant for an initial one-year period with three optional one-year extensions in the amount of $40,176.00 per year. Councilman

Councilman Barry McCullough moved to adopt RESOLUTION R-10-08, authorizing the City Manager to execute an agreement with Hi-Gene’s Janitorial Services for services at the Community Center for an initial one-year period with three optional one-year extensions in the amount of $67,845.00 per year. Councilman Mark Revenaugh seconded. The Vote All “aye” - Councilman Barry McCullough, Councilman Mark Revenaugh, Mayor Pro Tem Les Smith, and Mayor Carol Rudi. (4-0).


Councilman Barry McCullough moved to adopt RESOLUTION R-10-09, authorizing the City Manager to purchase one (1) 2010 Dodge Charger police car from Landmark Dodge for a total purchase amount of $21,413.45. Councilman Mark Revenaugh seconded. The Vote All “aye” - Councilman Barry McCullough, Councilman Mark Revenaugh, Mayor Pro Tem Les Smith, and Mayor Carol Rudi. (4-0).


Councilman Barry McCullough moved to adopt RESOLUTION R-10-10, authorizing execution of a contract with HoltHouse Construction LLC in the total amount not to exceed $154,107.00 for the Shady Lane at Antioch Road Water Main Replacement Project (WP1095). Councilman Mark Revenaugh seconded. The Vote All “aye” - Councilman Barry McCullough, Councilman Mark Revenaugh, Mayor Pro Tem Les Smith, and Mayor Carol Rudi. (4-0).


Councilman Barry McCullough moved to adopt RESOLUTION R-10-11, authorizing Change Order No. 6 in the amount of $153,149.00 to the contract with Miller Paving and Construction LLC for the 2009 Curb and Sidewalk Program. Phase 1, Project TP0904. Councilman Mark Revenaugh seconded. The Vote All “aye” - Councilman Barry McCullough, Councilman Mark Revenaugh, Mayor Pro Tem Les Smith, and Mayor Carol Rudi. (4-0).


Councilman Barry McCullough moved to adopt RESOLUTION R-10-12, authorizing execution of a contract with Heartland Contractors, Inc. in the total amount not to exceed $480,216.54 for the North Oak Enhancement—69th Street to 71st Street. Project CP1035.

Councilman Mark Revenaugh seconded. The Vote All “aye” - Councilman Barry McCullough, Councilman Mark Revenaugh, Mayor Pro Tem Les Smith, and Mayor Carol Rudi. (4-0).

Item 8. on the Agenda. COMMUNICATIONS FROM THE CITY COUNCIL.


Councilman Barry McCullough invited everyone to attend the City’s Home Show this weekend. It will be held at the Gladstone Community Center. The event will be held Saturday, February 27, from 9:00 AM to 7:00 PM. The emphasis is on “green” homes and things we can do to make our homes more “green”. Councilman McCullough congratulated Public Information Officer Richard King and everyone who worked to produce another nice “Coming Home to Gladstone” magazine.


Councilman Mark Revenaugh congratulated the Public Works Department for once again handling a lot of snow, and making it look like it was everyday life for folks in Gladstone. There were a lot of residents who would not have been able to get out of their homes and move around if it were not for the efficiency of our City’s snow plowing crew. Councilman Revenaugh asked Acting Public Works Director Tim Nebergall to pass this message along to the crewmembers, along with kudos from Council.


Councilman Revenaugh said our country has been in sore need of young people to go into the math, sciences, and technology areas, so he finds it extremely gratifying that there are so many young people present competing on the level that they are, and doing such an excellent job. Councilman Revenaugh offered congratulations to the Up NeXT team members.


Mayor Pro Tem Les Smith stated he wished to echo Councilman Revenaugh’s congratulations to the young folks. There are often reports about young people in not such flattering terms, and these young people here tonight should hold their heads high, and march out in their pink shirts, and feel good about themselves.


Mayor Pro Tem Smith welcomed back City Clerk Cathy Swenson, who has been gone for a while, and said she has been missed.


Mayor Pro Tem Smith said we rightfully focus a lot of attention on Public Works for snow removal, but we also have to “take our hats off” to the folks in the Parks and Recreation Department, who have their own set of responsibilities, and also to the Public Safety Department, who have to be out in this weather every day.

Councilman Mark Revenaugh seconded the motion. The Vote All “aye” - Councilman Barry McCullough, Councilman Mark Revenaugh, Mayor Pro Tem Les Smith, and Mayor Carol Rudi. (4-0).

Mayor Carol Rudi noted that Shawn Hartman and Charles Dobbs were in the audience, and asked them to please stand. Mayor Rudi pointed out to the young people in the audience that these two gentlemen have agreed to take on some duties for the City, and will be assisting the City in a number of areas, and this is something that City Council members will be looking forward to the youth in the audience also doing as they get a bit older. Mayor Rudi encouraged anyone interested in assisting the City, to call City Hall and volunteer.


Mayor Rudi thanked Mr. Hartman and Mr. Dobbs for agreeing to serve the City.


Mayor Rudi asked Acting Public Works Director Nebergall to let his department know that when she was at the Kansas City Home Show on Sunday, that people told her that Gladstone was in the news. News reporters were looking for a place to find lots of snow, but what they saw in Gladstone was City trucks clearing the streets. The reporters were on the border between Kansas City and Gladstone, so they saw the difference, and were impressed. Mayor Rudi thanked Mr. Nebergall.


Mayor Rudi said all four Council members present spent two days in Jefferson City this past week, talking to the State legislators. There are a lot of things going on in Jefferson City, and folks may go on the State’s website to see the Bills the State legislators are proposing, because it can make a big difference in everyone’s lives, and they need to hear from citizens.


Mayor Rudi said she spent Saturday morning in the office of Dr. Marx, who is a dentist in town, and this was his 22nd annual Have a Heart Day. He provided dental care for approximately 130 families. These children would not otherwise have received dental care. This year he was able to involve another dentist in the program, so he was able to increase their numbers. Mayor Rudi encouraged everyone to tell other dentists about this event, and encourage dentists to contact Dr. Marx so they may be a part of this program next year. Dr. Marx would like to expand this service. Mayor Rudi said she thinks it would be great to expand this program metro wide and eventually it should be a national program, because they donate everything, from the services, to the time of the technicians, to the dentists themselves, and toothbrushes, toothpaste, and all the information they give to the children. Mayor Rudi talked to one gentleman who had just lost his job, and his daughter was five years old, and had never been to the dentist, so it was her first visit to the dentist, so he was really happy to have this opportunity. Some other people who were there had to have an interpreter, because they did not speak English. People from all the Northland school districts were invited to participate in this program, on a “first come, first serve” basis. Mayor Rudi encouraged everyone who knows Dr. Marx to thank him, and to pass this information on his or her own dentist.


Mayor Rudi invited Parks and Recreation Director Sheila Lillis to share the “Tax Talks” date and times.


Parks and Recreation Director Sheila Lillis reported that H&R Block would be offering a complimentary tax seminar at the Community Center on Wednesday, February 24. There will be four different topics within a two-hour period. Starting at 10:00 AM, Tax Law Changes for 2009-2010; at 10:30 AM, Tax Issues for the Retired Taxpayer; at 11:00 AM, Job Loss/Search; and at 11:30 AM, Energy Efficiency.


Mayor Rudi said if anyone has tax questions, this will be a great opportunity on February 24, at the Gladstone Community Center.

Item 10. on the Agenda. RESOLUTION R-10-13, in support of the 2040 Adaptive Scenario developed by the Mid-America Regional Council (MARC).

Item 11. on the Agenda. PUBLIC HEARING: on a Site Plan Revision to Santerra at Shady Lane, First Plat. Applicant/Owner: Reveda of Gladstone, Inc. File #1343.


Mayor Rudi opened the Public Hearing and continued the Public Hearing to the March 8, 2010, City Council meeting.


Item 12. on the Agenda. FIRST READING BILL 10-02, amending Schedule V of the Model Traffic Code (Gladstone Municipal Code Section 4.100.020), to modify the current “No Parking” zone for traffic on Northwest 61st Terrace from North Wyandotte to North Main.


Councilman Barry McCullough moved to place Bill 10-02 on its First Reading. Councilman Mark Revenaugh seconded. The vote: All “aye” – Councilman Barry McCullough, Councilman Mark Revenaugh, Mayor Pro Tem Les Smith, and Mayor Carol Rudi. (4-0). The Clerk read the Bill.

Item 13. on the Agenda. FIRST READING BILL 10-03, allowing the “Show Me Green Sales Tax Holiday” to apply to the local sales taxes of the City of Gladstone between April 19 and April 25, 2010.


Councilman Mark Revenaugh moved to place Bill 10-03 on its First Reading. Councilman Barry McCullough seconded.


Mayor Rudi pointed out that Council would be considering two Bills for sales tax holidays this evening. On this Bill, in order to allow the sales tax to be exempted on these dates, Council would vote “yes”.


The vote: All “aye” – Councilman Barry McCullough, Councilman Mark Revenaugh, Mayor Pro Tem Les Smith, and Mayor Carol Rudi. (4-0). The Clerk read the Bill.

Item 14. on the Agenda. FIRST READING BILL 10-04, approving an Ordinance to Opt Out of the State imposed Sales Tax Holiday between August 6th and 8th, 2010.


Mayor Pro Tem Les Smith moved to place Bill 10-04 on its First Reading. Councilman Mark Revenaugh seconded.


Mayor Pro Tem Smith stated, as a point of clarification, this Bill would approve our City opting “out”, and therefore, if Council chooses to stay “in”, they would vote “no” on this reading at some point or at the Ordinance level.

The vote: All “aye” – Councilman Barry McCullough, Councilman Mark Revenaugh, Mayor Pro Tem Les Smith, and Mayor Carol Rudi. (4-0). The Clerk read the Bill.


Mayor Pro Tem Les Smith moved to accept the First Reading of Bill 10-04, Waive the Rule and place the Bill on its Second and Final Reading. Councilman Mark Revenaugh seconded. Mayor Pro Tem Les Smith moved to accept the Second and Final Reading of Bill 10-04 and to enact the Bill as Ordinance 4.134, with a recommendation to vote “no”. Councilman Mark Revenaugh seconded.


Roll call vote: All “nay” – Councilman Barry McCullough, Councilman Mark Revenaugh, Mayor Pro Tem Les Smith, and Mayor Carol Rudi. (0-4).


Mayor Pro Tem Smith, said, for the edification of the audience, that Council members did a good thing here, although, Council members voted “no”. State Statutes allow for opting “in” or “out” of an Ordinance that will allow a sales tax holiday in August, which is generally known as the “back to school” sales tax holiday that allows folks to buy school supplies without paying sales tax in the City of Gladstone on those dates. The State law requires the cities to act upon that from time to time. The Council just opted “in” to the sales tax holiday, so Council members encourage everyone to do their shopping for school supplies in Gladstone between August 6 and August 8.

Mayor Rudi agreed with Mayor Pro Tem Smith in encouraging folks to shop in Gladstone. Mayor Rudi said the previous Bill was for the “Show Me Green Sales Tax Holiday”. The State’s website lists a number of appliances that will receive additional rebates.


Mayor Pro Tem Smith pointed out that the State and City sales tax combined can be about seven percent, and if one is buying a $300 water heater that is energy efficient, that can add up to some real money, so Council members encourage everyone to take advantage of this opportunity in Gladstone.
