Mayor Les Smith opened the Regular September 27, 2010, City Council Meeting at 7:30 PM in the Gladstone City Council Chambers, and noted that all Council members were present.

Item 4. on the Agenda. APPROVAL OF THE REGULAR AUGUST 23, 2010, CITY COUNCIL MEETING MINUTES.


Councilman Mark Revenaugh moved to approve the Regular August 23, 2010, City Council Meeting Minutes as presented. Councilmember Carol Suter seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Mark Revenaugh, Councilman Carol Rudi, Mayor Pro Tem Barry McCullough and Mayor Les Smith. (5-0).




Item 5. on the Agenda. Approval of the August 19, 2010, City Council Meeting Minutes convening a Closed Executive Session.


Mayor Pro Tem Barry McCullough moved to approve the August 19, 2010, City Council Meeting Minutes convening a Closed Executive Session as presented. Councilman Carol Rudi seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Mark Revenaugh, Councilman Carol Rudi, Mayor Pro Tem Barry McCullough and Mayor Les Smith. (5-0).


Item 6. on the Agenda. Approval of the August 24, 2010, City Council Meeting Minutes convening a Closed Executive Session.


Councilmember Carol Suter moved to approve the August 24, 2010, City Council Meeting Minutes convening a Closed Executive Session as presented. Mayor Pro Tem Barry McCullough seconded. The vote: “Aye” – Councilmember Carol Suter, Councilman Mark Revenaugh, Mayor Pro Tem Barry McCullough and Mayor Les Smith. “Abstain” – Councilman Carol Rudi. (4-0-1).


Note: Councilman Rudi was absent from the August 24, 2010, meeting; therefore, she abstained from voting on approval of the meeting Minutes.


Item 7. on the Agenda. Approval of the September 8, 2010, City Council Meeting Minutes convening a Closed Executive Session and Closed Executive Session Minutes.


Councilman Mark Revenaugh moved to approve the September 8, 2010, City Council Meeting Minutes convening a Closed Executive Session and Closed Execution Session Minutes, as presented. Councilmember Carol Suter seconded. The vote: “Aye” – Councilmember Carol Suter, Councilman Mark Revenaugh, Mayor Pro Tem Barry McCullough and Mayor Les Smith. “Abstain” – Councilman Carol Rudi. (4-0-1).


Note: Councilman Rudi was absent from the September 8, 2010, meeting; therefore, she abstained from voting on approval of the meeting Minutes.


Item 8. on the Agenda. SPECIAL PRESENTATION BY THE MAYOR AND CITY COUNCIL.


Mayor Smith invited John Houlihan and David Velasquez to join him and the City Council in front of the dais. Mayor Smith stated that these two gentlemen were not able to be present at an earlier City Council meeting to be recognized for their contributions in City election campaigns. Mayor Smith said that Mr. Houlihan had a leadership role in the two Bond issues election this year, and Mr. Velasquez played a leadership role in the Public Safety Sales Tax election this year; however, both of them also worked in both campaigns. Both of them helped carry the water, and did a fantastic job in getting a positive consensus from the citizens. Mayor Smith said he and the City Council wanted to show their appreciation with a framed certificate, and to thank them for all the hard work they did to ensure the passage of these two elections.


Mr. Velasquez thanked the Mayor and Council and said this is a great city in which to live. There were so many people involved in this that it made it so easy. Jean Moore did such a great job. Mr. Velasquez said he was invited to be a part of this effort, but unfortunately, his job took him away more than he had planned. Mr. Velasquez said that people like Everett Jones, Councilman Carol Rudi, the Mayor, and a lot of people were involved, so this is really more than what any one person could ask for.


Mr. Houlihan said he wished to echo that, and expressed thanks to Mayor Smith, the City Council, Pete Hall, and Bill Garnos. Mr. Houlihan said the 78 percent approval rate was gratifying, and he expressed his appreciation to all who helped with the election.


Item 9. on the Agenda. PROCLAMATION designating September 23-30, 2010, as “ConstituTION WEEK” in Gladstone, Missouri. Sponsor: William Boydston Chapter of the Daughters of the American Revolution.


Mayor Smith read and presented the Proclamation to Freddie Nichols, a committee chairman, of the William Boydston Chapter of the Daughters of the American Revolution. Mayor Smith pointed out that the Proclamation was not framed at the request of Ms. Nichols.


Ms. Nichols said that was correct, as the Proclamation will be filed in the organization’s scrapbook. Ms. Nichols thanked the Mayor and the City Council and said this presentation is not taken lightly. All the schools in Gladstone receive information regarding Constitution Week. Ms. Nichols said the actual week is September 17–23, but her organization was slow in requesting this Proclamation, and the City Council did not meet earlier in September, due to a conference most of the Council attended.


Item 10. on the Agenda. PROCLAMATION designating September 2010, as NATIONAL CHILDHOOD OBESITY AWARENESS MONTH in Gladstone, Missouri.


As there was no one present to accept the Proclamation, Freddie Nichols offered to accept the Proclamation on behalf of the Clay County Health Department, and thanked the Mayor and City Council for recognizing this important issue.


Item 11. on the Agenda. PROCLAMATION designating October 2010, as WALK AND BICYCLE TO SCHOOL MONTH and October 6, 2010, “INTERNATIONAL WALK TO SCHOOL DAY” in Gladstone, Missouri.


Mayor Smith read and presented the Proclamation to Doug Miller, of Linden West Elementary School.


Mr. Miller thanked the Mayor and City Council and said that Linden West School would celebrate the day on Friday, October 8, and he thanked the Gladstone Ambulance, Fire Department and Police Officers who would be at the meeting place – the Gladstone Bowl parking lot – to assist with the students and adults who will be walking to school that day. Mr. Miller invited anyone who wished to join them to meet at the Gladstone Bowl parking lot at 8:15 AM.


Item 12. on the Agenda. CONSENT AGENDA


Following the Clerk’s reading, Councilman Carol Rudi moved to accept the Consent Agenda as presented. Councilmember Carol Suter seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Mark Revenaugh, Councilman Carol Rudi, Mayor Pro Tem Barry McCullough and Mayor Les Smith. (5-0).


Councilman Carol Rudi moved to adopt RESOLUTION R-10-50, authorizing acceptance of work under contract with Site Rite Construction Company, for the Sanitary Sewer Improvements – 58th Terrace and North Euclid Project; and authorizing final payment in the amount of $30,535.54. Councilmember Carol Suter seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Mark Revenaugh, Councilman Carol Rudi, Mayor Pro Tem Barry McCullough and Mayor Les Smith. (5-0).


Councilman Carol Rudi moved to adopt RESOLUTION R-10-51, authorizing acceptance of work under contract with Commercial Aquatic Services, Incorporated, for the purchase of three (3) Ultraviolet Disinfection Treatment Systems; and authorizing final payment in the amount of $4,133.70. Councilmember Carol Suter seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Mark Revenaugh, Councilman Carol Rudi, Mayor Pro Tem Barry McCullough and Mayor Les Smith. (5-0).


Councilman Carol Rudi moved to adopt RESOLUTION R-10-52, authorizing execution of a contract between the City of Gladstone, Missouri, and DOCVIEW, LLC, to provide electronic access to City of Gladstone, Missouri traffic accident reports. Councilmember Carol Suter seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Mark Revenaugh, Councilman Carol Rudi, Mayor Pro Tem Barry McCullough and Mayor Les Smith. (5-0).


Councilman Carol Rudi moved to approve a BUILDING PERMIT for replacement of existing Verizon antennas with new updated antennas on the Linden Water Tower. Applicant: Burroughs Creek. Owner: City of Gladstone. Councilmember Carol Suter seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Mark Revenaugh, Councilman Carol Rudi, Mayor Pro Tem Barry McCullough and Mayor Les Smith. (5-0).


Councilman Carol Rudi moved to approve a BUILDING PERMIT for replacement of existing Verizon antennas with new updated antennas on the Antioch Water Tower. Applicant: Burroughs Creek. Owner: City of Gladstone. Councilmember Carol Suter seconded. Councilman Carol Rudi moved to approve the following ANNUAL LIQUOR LICENSE RENEWALS:


Tommy’s, 6221 North Chestnut, Class “AR&B” Liquor by the Drink License.

Snappy Store #4901, 4901 North Old Pike Road, Class “C&H” Package Liquor License.

Item 13. on the Agenda. COMMUNICATIONS FROM THE AUDIENCE.


Shirley Smith, 103 NE 67th Street, said she had four quick thank you’s for the City of Gladstone. Ms. Smith thanked the City for the west ingress/egress that was allowed Quik Trip on 72nd Street. That intersection is horrendous with Walmart, Hy-Vee, and Quik Trip, and it is still pretty rugged, but it is much better now, and we are glad for all the business. Ms. Smith thanked the Council for the adjustment of the traffic signals on North Oak Trafficway; she goes to church at 8:00 on Sunday morning, and used to sit at red lights, with no other car anywhere, and now it is so much easier with the lights timed. Ms. Smith thanked the City Council for the stop sign at North Walnut and North Main, which is right down the street from her. Northeast 67 Street has always been one of the few east/west streets, and many people use it for a throughway between North Oak and Broadway, going down to the 169 Highway entrance. At traffic times it is like a mountain bike ski run, but that stop sign has toned it down some. The traffic may not stop, but they do slow down, and realize that there is a sign there, and it makes drivers realize that it is a residential street and not a freeway. Ms. Smith said our City really needs more east/west streets. Ms. Smith thanked the City Council for the Gladstone Plaza renovations – it is wonderful!


Mayor Smith informed the audience that Ms. Smith is a former Councilman, and thanked her for her comments, and asked Public Safety Director Mike Hasty if he made note of Number 3 on Ms. Smith’s list.


Director Hasty replied that he did make note of that.


Item 14. on the Agenda. COMMUNICATIONS FROM THE CITY COUNCIL.


Councilmember Carol Suter inquired into the completion time of the trail project on North Prospect.


City Manager Kirk Davis replied the contractor is winding up everything that he is doing, and in his opinion, this has been a messy construction site. The contractor will be cleaning up the site. The contractor is doing a lot of work down the hill, and there is signage that needs to be placed, then they should be done. The project should be completed relatively soon.


Councilmember Suter welcomed John Garner back, and said it was good to see him operating under his own steam. Mr. Garner regularly attends these meetings.


Councilman Mark Revenaugh stated that it struck him that one of the reasons that the Community Center is so successful is because of the tremendous amount of planning and thought from the residents that went into the planning of that structure. Councilman Revenaugh said that even though the Village Center is not moving as rapidly as we would all have hoped, there is still a lot of planning and forethought going into it, so by the time we do have it built, there is no doubt in his mind that it is going to be one spectacular area. The fact that our City is getting 150 streetlights from the government is going to translate into a crime savings, because there is a direct correlation between streetlights and crime and safety; and in addition to that, although, he is uncertain as to the exact cost, that will also be quite a cost savings for the citizens of Gladstone.


City Manager Davis stated the cost of the streetlights is about $150 per light.


Councilman Revenaugh thanked City Manager Davis, and said he is glad that we are continuing work on the Village Center Square, and we are still moving forward.


Councilman Carol Rudi reminded everyone of Gladfest this weekend - it is a great event, and she hopes everyone will attend, and have a good time. Councilman Rudi said that on October 5, at 6:00 PM, at the Community Center, will be the City’s next art exhibit opening, and Water Colorist Margarita Tinder will be featured. Councilman Rudi encouraged everyone to attend this event.


Councilman Rudi said that Public Works Director Tim Nebergall may want to make a note that there are potholes in the streets going in to Meadowbrook North from M-1 Highway. Councilman Rudi said she has not mentioned it before, because she has been waiting for the construction to be finished. All three streets need to be looked at.


Mayor Pro Tem Barry McCullough thanked City Manager Davis for opening up the brush drop-off for folks to use to relieve their yards that were damaged in the last couple of weeks. Mayor Pro Tem McCullough said he hopes everyone has a great time at Gladfest this weekend.


Mayor Les Smith reported that the Chiefs requested a Red Friday Proclamation, which our City presented over the City Council’s break the last couple of weeks. Mayor Smith said he wished to remind everyone that a project that has been worked on for a couple of years or more, the Walmart expansion, will have a grand opening on October 6, at 8:00 AM, and he invites everyone to attend that function.


Mayor Smith said today he attended the dedication ceremony for the new Christopher S. Bond Bridge. On the news this evening, it was reported that this project is nearly a year ahead of schedule, approximately $20 million under budget, and they have committed to having all lanes of traffic, with no construction detours, open by the end of this year, which is a phenomenal feat. The easier that we can get back and forth across the river the less we have the psychological divide of a river. It is quite a project, and it was phenomenal that they let folks walk across the bridge. When one stands and looks up at the big arch and all the cables, it is quite an impressive project. A lot of folks in the Northland had a lot to do with that project, along with Senator Bond, who came up with the last $50 million that it cost to build the bridge. We have a debt of gratitude to him and the other Northlanders and congressional leaders who worked on this project.


Mayor Smith said he wished to welcome John Garner back. Mr. Garner had some health issues, of which they kept us abreast, and it is great to see him back. Mayor Smith said he sees a lot of brush in our City stacked at the curbs, and he believes people are expecting the City to pick it up, and asked City Manager Davis if there is a plan in place for that.


City Manager Davis replied that the plan right now is to maintain an open Public Works facility through Friday, and then it will be evaluated how much brush is at the curbs still, and see what the options are.


Mayor Smith said that Kansas City put out a Press Release as to where they would pick up brush, and the description was poorly written, and it made it sound like it was from Holmes to I-435, and Parvin Road to 72nd Street. Mayor Smith said the southeast corner of our City was hit by the storm more heavily than other areas, and there is a lot of brush piled on the curbs. Mayor Smith said he believed that there is an expectation that we will be picking that up, so in the next couple of days we may want to evaluate that and decide how to proceed.


Item 15. on the Agenda. COMMUNICATIONS FROM THE CITY MANAGER.


City Manager Kirk Davis introduced Chris Williams, of the Williams and Campo Law Firm, whose firm will be serving as the interim Counsel, until the City is in a position to hire another City Attorney. City Manager Davis welcomed Mr. Williams, and said he has been with our City before, and served as interim Counsel about ten years ago, and he has known him for about 20 years, and he is a very competent attorney, and he is glad he is with us.


City Manager Davis reminded everyone that City Hall will be closed Friday at Noon, for the public, due to Gladfest.


Item 16. on the Agenda. RESOLUTION R-10-53, authorizing the City Manager of the City of Gladstone, Missouri to execute an agreement on behalf of the City of Gladstone, Missouri with Williams & Campo, for the position of Interim City Counselor.

Item 17. on the Agenda. RESOLUTION R-10-54, authorizing execution of a cooperative agreement between the City of Gladstone, Missouri and Northaven Village Condominiums, LLC, for construction improvements, according to the general standards established for public improvements within the City of Gladstone City Code, in the Northaven Village Condominiums residential area.


Councilmember Carol Suter moved to adopt RESOLUTION R-10-54, authorizing execution of a cooperative agreement between the City of Gladstone, Missouri and Northaven Village Condominiums, LLC, for construction improvements, according to the general standards established for public improvements within the City of Gladstone City Code, in the Northaven Village Condominiums residential area. Mayor Pro Tem Barry McCullough seconded.


Councilman Mark Revenaugh asked for some information about this project.


Assistant City Manager Scott Wingerson reported that this is an agreement that says if a developer does certain things, the City will accept the streets. The streets through the Northaven Village Condominiums area are currently private. They were built in the late 1970’s and early 1980’s. It is currently the developer’s goal to dedicate those streets for public maintenance, so staff is trying to define the terms under which that can occur. A lot of the rehabilitation and reconstruction over the last 25 years has been completed, and staff will make final inspection, put together the legal paperwork for acceptance, and bring it back to the City Council, when everything is in ship-shape order for the residents.
