ADJOURNMENT TO CLOSED EXECUTIVE SESSION
6:30 PM
Mayor Pro Tem Barry McCullough opened the City Council Meeting to adjourn to a Closed Executive Session on December 20, 2010, at 6:30 PM. Mayor Pro Tem Barry McCullough made a motion to adjourn to Closed Executive Session pursuant to Missouri Open Meeting Act Exemption 610.021(1) for Litigation and Confidential or Privileged Communications with Legal Counsel. Councilmember Carol Suter seconded.
Roll Call Vote: All “aye” – Councilmember Carol Suter, Councilman Mark Revenaugh, Councilman Carol Rudi and Mayor Pro Tem Barry McCullough. (4-0)
Mayor Les Smith was absent from the vote, but was present at the Closed Executive Session.
Mayor Les Smith adjourned the Closed Executive Session to go into the Special City Council Meeting.

Item 2. on the Agenda. ROLL CALL
Mayor Les Smith opened the Special December 20, 2010, City Council Meeting at 6:45 PM in the Gladstone City Council Chambers, and noted that all Council members were present.
Item 3. on the Agenda. PLEDGE OF ALLEGIANCE.
Mayor Les Smith led the Pledge of Allegiance, in which all joined.

REGULAR AGENDA.
Item 4. on the Agenda. COMMUNICATIONS FROM THE AUDIENCE.
There were no communications from the audience.
Item 5. on the Agenda. COMMUNICATIONS FROM THE CITY COUNCIL.
Councilmember Carol Suter had no comments at this time.
Councilman Mark Revenaugh had no comments at this time.
Councilman Carol Rudi wished everyone a Merry Christmas!
Mayor Pro Tem Barry McCullough had no comments at this time.
Mayor Les Smith wished everyone a Merry Christmas and Happy New Year!
Item 6. on the Agenda. COMMUNICATIONS FROM THE CITY MANAGER.
City Manager Kirk Davis had no comments at this time.
Item 7. on the Agenda. APPROVAL OF AN ANNUAL LIQUOR LICENSE RENEWAL:
RNB, LLC, dba Red Night Club, 316 NE 72nd Street; Class A Liquor by the Drink License.
Interim City Counselor Chris Williams stated it was his recommendation to remove Item 7. from the Agenda.
Mayor Les Smith said Item 7. would be removed from the Agenda, at the recommendation of Interim City Counselor Chris Williams.
Item 8. on the Agenda. RESOLUTION R-10-73, authorizing a Settlement Agreement and Release between the City of Gladstone, Missouri and RNB, LLC, dba “RED”.
Councilman Carol Rudi moved to adopt RESOLUTION R-10-73, authorizing a Settlement Agreement and Release between the City of Gladstone, Missouri and RNB, LLC, dba “RED”. Councilmember Carol Suter seconded.
Councilman Rudi said she wished to point out that there has been considerable discussion over this particular business, and the City Council was on the verge of not approving a Liquor License for them at one point, but the City Council has reached an agreement that is hoped will be satisfactory to everyone involved, and that all of the items in the agreement would be followed very carefully.
Councilman Mark Revenaugh stated that he hoped that if this particular business continues to be a bad neighbor or a bad corporate citizen going forward, causing our Public Safety office undue number of calls and amounts of time, that this Council would move quickly to rescind their Liquor License.
Councilman Rudi said she agreed.
The vote: All “aye” – Councilmember Carol Suter, Councilman Mark Revenaugh, Councilman Carol Rudi, Mayor Pro Tem Barry McCullough and Mayor Les Smith. (5-0).

There being no further business to come before the December 20, 2010, Gladstone Special City Council Meeting, Mayor Les Smith adjourned the meeting.
