Mayor Mark Revenaugh opened the Regular October 27, 2008, City Council Meeting at 7:30 PM in the Gladstone City Council Chambers.


Item 2. on the Agenda. ROLL CALL


Mayor Mark Revenaugh noted that all Council members were present.


Item 3. on the Agenda. PLEDGE OF ALLEGIANCE.


Mayor Mark Revenaugh led the Pledge of Allegiance, in which all joined.


Item 4. on the Agenda. APPROVAL OF THE OCTOBER 13, 2008, CITY COUNCIL MEETING MINUTES.


Mayor Pro Tem Carol Rudi moved to approve the Regular October 13, 2008, City Council Meeting Minutes as presented. Councilmember Carol Suter seconded. The vote: “Aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Les Smith, Mayor Pro Tem Carol Rudi, and Mayor Mark Revenaugh. (5-0)




Item 5. on the Agenda. PROCLAMATION: Recognizing the OAK PARK HIGH SCHOOL BAND for the long partnership the City has enjoyed with them, and for the new HAPPY ROCK MARCH, written by HEAD DIRECTOR OF BANDS ADAM FARLEY, which was first performed during the 2008 Gladfest parade in honor of the City of Gladstone’s All America City Award.


Mayor Revenaugh announced that this was a special occasion for the City, and said it was not very often that someone goes to the trouble of writing a piece of music specifically for anyone, especially a city. The City was honored by Oak Park Band Director Adam Farley, who wrote the Happy Rock March, which was performed at Gladfest this year. It is a great piece of music. Mayor Revenaugh said that he used to march in the Oak Park Marching Band, and has played more than his share of marches, and believes he knows a little bit about marching band music. Mayor Revenaugh said that Council was presented with a framed collage of the Happy Rock March music, and he expressed the appreciation of the City Council and the community to Mr. Farley and the band members.


Mayor Revenaugh read and presented a Proclamation to Mr. Farley and members of the Oak Park Marching Band in recognition of the long partnership the City has enjoyed with Oak Park High School and the North Kansas City School District. Mayor Revenaugh extended heart felt appreciation from the City Council and the community to the Oak Park High School Band, and expressed best wishes for many years of continued success in providing outstanding leadership in music to the Northland Community.


Mr. Farley thanked the Mayor and City Council.


Item 6. on the Agenda. PROCLAMATION: Recognizing NATIONAL COMMUNITY PLANNING MONTH and the valuable contributions made by citizen involvement and professional planners of the City of Gladstone.


Mayor Revenaugh read and presented the Proclamation to Planning Specialist Chris Helmer.


Mr. Helmer accepted the Proclamation and said it comes at a wonderful time for the City, who just received the Comprehensive Plan Award, which was presented by the Missouri Chapter of the American Planning Association (APA), at Crown Center Hotel, during the bi-state APA Conference. Mr. Helmer stated that he and City Manager Kirk Davis were present with the consultant team, BWR. The comprehensive plan is what not only helps the City make decisions in the near term, but for the long term as well. The comprehensive plan addresses challenging issues the City faces, such as housing issues, aging infrastructure and transit. Mr. Helmer concluded by thanking the City’s leadership team, the Planning Commission members, the Comprehensive Plan Steering Committee, and the City Council for their guidance.


Mayor Revenaugh pointed out that there were representatives from Boy Scout Troop 303, sponsored by the Martin Luther Academy. Mayor Revenaugh invited Mr. Alan Parker, Scout Master, and his son Trevor Parker, who is working on his Citizenship Badge, to stand and be recognized.

Following the Clerk’s reading, Councilman Wayne Beer moved to accept the Consent Agenda as presented. Mayor Pro Tem Carol Rudi seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Les Smith, Mayor Pro Tem Carol Rudi, and Mayor Mark Revenaugh. (5-0)


Councilman Wayne Beer moved to adopt RESOLUTION R-08-73, authorizing execution of a Water Tower Antenna Site Lease with T-Mobile Central LLC, a Delaware Limited Liability Company, for the Antioch Water Tower. Mayor Pro Tem Carol Rudi seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Les Smith, Mayor Pro Tem Carol Rudi, and Mayor Mark Revenaugh. (5-0)


Councilman Wayne Beer moved to adopt RESOLUTION R-08-74, authorizing acceptance of work under contract with Mega Industries Corporation for the M-1 at Kendallwood Road Improvement Project 045022; and authorizing final payment in the amount of $6,346.78. Mayor Pro Tem Carol Rudi seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Les Smith, Mayor Pro Tem Carol Rudi, and Mayor Mark Revenaugh. (5-0)


Councilman Wayne Beer moved to adopt RESOLUTION R-08-75, authorizing acceptance of a donation made to the Gladstone Animal Shelter by Bettie M. Breeding and Benjamin J. Breeding, and further directing that all funds donated to the shelter by Bettie M. Breeding and Benjamin J. Breeding be used solely for the benefit of the facilities for the animals at the shelter. Mayor Pro Tem Carol Rudi seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Les Smith, Mayor Pro Tem Carol Rudi, and Mayor Mark Revenaugh. (5-0)


Councilman Wayne Beer moved to adopt RESOLUTION R-08-76, adopting an Identity Theft Prevention Program for the City of Gladstone, Missouri. Mayor Pro Tem Carol Rudi seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Les Smith, Mayor Pro Tem Carol Rudi, and Mayor Mark Revenaugh. (5-0)


Councilman Wayne Beer moved to approve a BUILDING PERMIT for construction of an antenna halo on the top of the Antioch Water Tower, located at 6803 Northeast Antioch Road. Applicant: Selective Site Consultants, Inc. Owner: City of Gladstone. Mayor Pro Tem Carol Rudi seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Les Smith, Mayor Pro Tem Carol Rudi, and Mayor Mark Revenaugh. (5-0)


Councilman Wayne Beer moved to approve a BUILDING PERMIT to enclose the carport on the North side of the White Chapel Funeral Home, located at 6600 Northeast Antioch Road. Applicant/Owner: Stewart Enterprises (D.W. Newcomers). Mayor Pro Tem Carol Rudi seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Les Smith, Mayor Pro Tem Carol Rudi, and Mayor Mark Revenaugh. (5-0)


Councilman Wayne Beer moved to approve a NEW CLASS “A” LIQUOR BY THE DRINK LICENSE for The Office JJNJ dba The Office Bar and Grill, 6825 North Oak Trafficway. Managing Officer: Jennifer Kasserman. Mayor Pro Tem Carol Rudi seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Les Smith, Mayor Pro Tem Carol Rudi, and Mayor Mark Revenaugh. (5-0)


Councilman Wayne Beer moved to approve the SEPTEMBER 2008 FINANCIAL REPORT. Mayor Pro Tem Carol Rudi seconded. The vote: All “aye” – Councilmember Carol Suter, Councilman Wayne Beer, Councilman Les Smith, Mayor Pro Tem Carol Rudi, and Mayor Mark Revenaugh. (5-0)


REGULAR AGENDA


Item 8. on the Agenda. COMMUNICATIONS FROM THE AUDIENCE.


Donald Harper, 1606 NE 68th Terrace, stated that he had listened through the Study Session to Mr. Napoli’s Open Storage Policy proposed Ordinance. Mr. Harper stated he that should the City adopt the Ordinance, he foresees an additional move of some of these things to the street. There are already closed storage trailers parked on the street that are being used as storage facilities, as well as open trailers on the street with “junk” in them, and clamping down on the property in the yard, if there is not also a companion Ordinance to cover what is sitting out on the public street, might increase that. Mr. Harper suggested and requested that Council take into consideration some kind of limitation on people being able to park open or closed trailers on the street, unhooked from a vehicle, for a certain period of time, or some kind of control to keep them from storing property on the street, and, to a degree, obstructing traffic.


Item 9. on the Agenda. COMMUNICATIONS FROM THE CITY COUNCIL.


Councilmember Carol Suter had no comments at this time.

Councilman Wayne Beer had no comments at this time.


Councilman Les Smith apologized for missing the Study Session and stated that he was suppose to be back in town in plenty of time, but in Atlanta it was discovered that his plane had a flat tire. It was probably better that it was discovered before they took off rather than after.


Mayor Pro Tem Carol Rudi stated that Mr. Farley has a wonderful role model in his mother, as she had been elected as the Citizen of the Year for Gladstone with the West Gate division of the Missouri Municipal League. Mr. Farley comes from a great family and seems to be carrying on that tradition.


Mayor Pro Tem Rudi announced that for anyone who does not know, the City does accept donations like the Animal Control donation mentioned earlier in the Agenda, and anyone who would like to donate to things like the Animal Shelter, Atkins-Johnson Farm, Theatre in the Park, or Art Springs in Gladstone, please feel free to help the City out in any way possible. The City even has scholarships for our Parks and Recreation Department Programs and park benches. Mayor Pro Tem Rudi stated if you can think it up, we will find a way to accept your money!


Mayor Mark Revenaugh invited all to attend the Mayor’s Christmas Tree Lighting Ceremony on November 25, 2008, at 6:00 PM, at the First Bank of Missouri, on Antioch Road. Mayor Revenaugh said that Santa Claus and a nice choral group will be on hand. Donations will be accepted to benefit those in need in the Northland.


Item 10. on the Agenda. COMMUNICATIONS FROM THE CITY MANAGER.


City Manager Kirk Davis announced November 7, 8, and 9, 2008 is brush disposal weekend. City Manager Davis stated that a large swim meet, the Suburban Conference Meet, will be held at the Natatorium this weekend. Staff is excited about hosting the event and the Natatorium is receiving a lot of positive publicity.


City Manager Davis said we have a rather aggressive fleet maintenance program in this year’s budget and the first patrol car has arrived. We are still waiting for the other two, but the first one has arrived, and you may see that very distinctive “black and white” out there on the street. City Manager Davis complimented the Public Works Department, who helped equip the vehicle, and Public Safety for their input into the design and necessary equipment. City Manager Davis concluded by saying that the vehicle looks pretty sharp and hopefully we will see 26 or 27 more new vehicles shortly.


Councilman Wayne Beer said it looks like a “real police car”.

Mayor Revenaugh agreed and asked when the rest of the new City fleet would be hitting the streets.


City Manager Davis stated that he understands that the production on the hybrids is going to begin around November 10, 2008, and that staff has vehicle identification numbers for those vehicles.


Mayor Revenaugh asked if the vehicles were made at the Ford Claycomo Plant.


City Manager Davis confirmed that the vehicles were made at the Ford Claycomo Plant.


Item 11. on the Agenda. PUBLIC HEARING for consideration of a Sign Variance to allow construction of a sign with an electronic reader board at Antioch Bible Baptist Church, located at 800 NE 72nd Street. Applicant/Owner: Antioch Bible Baptist Church.


Mayor Revenaugh asked Assistant City Manager Scott Wingerson to give the status report on the Sign Code Focus Committee’s progress and asked when Council could expect their findings.

Assistant City Manager Scott Wingerson replied, Council appointed a Sign Code Focus Group roughly a year ago and their charge from the City Council was to review the issue of all monument signage, specifically the monument signage that included any kind of electronic message reader board, whether it be a video display, or any of those types of things. The Focus Group has done that and it has been very difficult. The Focus Group went several different directions and recently settled on a recommendation to the City Council. Staff is in the process of a final review before it is presented as a Study Session to the City Council. Mr. Wingerson suggested December as the time frame to make that presentation to Council.


Mayor Revenaugh asked if it was reasonable to expect to have the findings in a reasonable amount of time in December, so that Council could move forward on the Public Hearing for the sign variance.


Mr. Wingerson responded that he did not want to presume that the Council would approve the recommendation of the Sign Code Focus Group, but if Council goes in a similar direction, based on their recommendation, then the end of December or the first of January would be a reasonable time frame.


Mayor Revenaugh tabled the Public Hearing and rescheduled the Public Hearing for the December 2008, City Council Meeting.


Item 12. on the Agenda. RESOLUTION R-08-77, authorizing the City Manager to negotiate a loan agreement to provide $500,000.00 for the preservation of the Atkins-Johnson Farm House and related expenses.


Councilmember Carol Suter moved to adopt RESOLUTION R-08-77, authorizing the City Manager to negotiate a loan agreement to provide $500,000.00 for the preservation of the Atkins-Johnson Farm House and related expenses. Councilman Carol Rudi seconded.


Councilman Rudi stated that this is a wonderful program.


Councilmember Suter said she was excited to see the City getting to the place where this is becoming real. It has been talked about for several years, and this is exciting.


Mayor Revenaugh asked City Manager Davis if the money is in the City’s budget.


City Manager Davis replied that the City annually provides $35,000 for the Atkins-Johnson Farm Restoration Project. The City is at the point now where we can leverage that and really make progress in terms of the restoration, and in addition to that there is a $150,000 loan from the City to the Atkins-Johnson limited partnership that will be paid back when they sell the tax credits. It infuses another $150,000, and when one looks at the construction progress that has been laid out by architects, that $500,000 is a critical number. It allows the City to expedite making that facility available to the public for educational purposes and allows us to achieve the public benefit much faster. Rather than wait around for that additional $150,000, we can move forward and plan all the necessary work, and we will be reimbursed from the tax credits. That is how we arrived at the $500,000.

Item 13. on the Agenda. RESOLUTION R-08-78, expressing the gratitude of the City Council for the service of the members of the Atkins-Johnson Farm Task Force, dissolving the Task Force, and expressing the City Council's support for the "Friends of the Atkins-Johnson Farm" volunteer organization.


Mayor Pro Tem Carol Rudi moved to adopt RESOLUTION R-08-78, expressing the gratitude of the City Council for the service of the members of the Atkins-Johnson Farm Task Force, dissolving the Task Force, and expressing the City Council's support for the "Friends of the Atkins-Johnson Farm" volunteer organization. Mayor Pro Tem Rudi commented that a number of people have worked for a number of years on this project. Several of them have continued on with the Friends of the Farm, and will stay involved with this. We do owe them a debt of gratitude as they have brought this a long way.

Item 14. on the Agenda. FIRST READING BILL 08-29, amending Ordinance Numbers 2.941 and 3.405 by enacting new provisions in conformity with the “2007 Video Services Providers Act”.

Item 16. on the Agenda. OTHER BUSINESS.


Councilman Les Smith stated going back to City Manager Davis’s comments regarding the City’s fleet replacement, we have taken a tremendous first step through some creative financing, in compliance with our goals, with making headway with the Mayors’ Climate Protection Agreement. We need to take every opportunity to inform our citizens that we have an Environmental Management Advisory Committee that has some vacancies on it. We have an opportunity for some folks with some real passion for environmental protection and sustainability initiatives to get involved on this committee. Councilman Smith said he hopes the City can find some folks, and he invited anyone in the audience who knows of someone who might share this passion to ask them to submit a letter of interest to the City Clerk for Boards and Commission appointments. This is a real opportunity for some people in our community to make a difference. Councilman Smith said he hopes we can find some folks who want to become involved with this effort.


Mayor Revenaugh agreed, and said letters will be going out next week that will be addressing this.
